1. About These Terms

These Terms and Conditions (“Terms”) govern access to and use of the ProCam Australia website (www.procam.au), the ProCam AU mobile application, ProCam product information, manuals and support materials, and ProCam dash cameras, accessories, software and firmware.

In these Terms, “ProCam”, “we”, “our” and “us” mean The Trustee for Proview Trust (ABN 80 296 329 963), trading as ProCam. “You” and “your” mean any person who accesses the website or uses a ProCam product, application or related service.

By using the website, application or products, you acknowledge these Terms. A purchase from an authorised dealer is also subject to that dealer’s applicable sales, installation and service terms.

2. Dealer-Exclusive Products

ProCam is a dealer-exclusive brand in Australia. Products are supplied through authorised dealers and installers and are not sold directly to consumers through the ProCam website. Website content does not constitute a direct offer by ProCam to sell a product to you.

The authorised dealer is responsible for:

  • Accepting and processing the order

  • Providing prices and payment terms

  • Arranging supply or installation

  • Issuing proof of purchase

  • Providing delivery or collection arrangements

  • Handling returns and remedies in accordance with applicable law

Dealer pricing, installation charges, availability and promotions may vary between dealers.

3. Authorised Dealers and Installers

Authorised ProCam dealers and installers are independently operated businesses unless expressly stated otherwise, and are responsible for their own quotations, representations, workmanship and additional products or services.

A customer with an issue relating specifically to a dealer’s sale or installation service should contact that dealer first, and may also contact ProCam for product information or assistance.

Nothing in this section limits any responsibility ProCam may have under the Australian Consumer Law or any liability that cannot lawfully be excluded.

4. Product Information

Reasonable care is taken to ensure product descriptions, specifications, compatibility information, images, videos and other website content are accurate. However:

  • Specifications, packaging and included accessories may change

  • Images may be illustrative

  • Colours and appearance may vary

  • Application and firmware functions may be updated

  • Feature availability may depend on model or installation

  • Vehicle compatibility may require dealer confirmation

Customers should confirm the model, included components, vehicle compatibility, installation requirements and available features with an authorised dealer before purchasing.

5. Installation and Vehicle Compatibility

ProCam dash cameras must be installed and operated in accordance with the applicable user manual and installation instructions. Professional installation by an authorised or suitably qualified installer is recommended, particularly where a product is hardwired or connected to parking-mode equipment, an external rear camera, a battery pack, vehicle electrical wiring, or another accessory or power source.

Subject to the Australian Consumer Law, ProCam is not responsible for damage or performance issues caused by incorrect or unauthorised installation, incompatible wiring, unauthorised modification, an unsuitable power supply, improper positioning or failure to follow the supplied instructions.

6. Dash Camera Operation

A ProCam dash camera is a driving and recording aid. It does not replace safe driving, vehicle security, insurance or compliance with road laws. ProCam does not guarantee that a dash camera will:

  • Record every journey, event or incident

  • Capture every vehicle, plate, person or surrounding detail

  • Prevent an accident, theft, break-in or vehicle damage

  • Produce clear footage in every environment

  • Continue operating after a significant collision or power interruption

  • Provide footage suitable for every evidentiary, insurance or legal purpose

Recording quality may be affected by lighting, weather, speed, camera position, reflections, window tint, dirt, obstruction, vibration, distance, impact and other environmental or technical factors.

7. Recordings and Data Loss

It is not possible to guarantee that every recording will be created, retained or successfully retrieved. Data may be lost, deleted, overwritten, incomplete, inaccessible or corrupted for a wide range of reasons, including normal loop recording, memory-card failure, incorrect settings, power interruption, impact, incorrect installation, hardware or firmware failure, environmental conditions, card removal during writing, failure to maintain the card, or circumstances outside ProCam’s reasonable control.

Customers are responsible for:

  • Confirming the camera is powered and recording

  • Checking view, date, time and settings

  • Reviewing recordings periodically

  • Using and maintaining a compatible high-endurance memory card

  • Replacing a worn or unreliable card

  • Promptly backing up important recordings, which should not be left solely on the camera’s memory card

To the maximum extent permitted by law, ProCam, the manufacturer, and their suppliers and distributors are not responsible for loss, deletion, corruption, non-recording or inability to retrieve footage where the loss was not caused by a breach of a consumer guarantee or other legal obligation that cannot be excluded; nor for indirect or consequential loss arising from unavailable, incomplete or corrupted footage.

Nothing in this section excludes any right or remedy that cannot lawfully be excluded under the Australian Consumer Law.

8. No Guarantee of Evidentiary or Insurance Outcome

ProCam does not guarantee that footage will establish responsibility for an incident, identify a vehicle or person, be accepted by police, an insurer or a court, support an insurance claim, or produce a particular legal or commercial outcome.

Customers are responsible for preserving and providing recordings to the appropriate organisation when required. ProCam does not determine admissibility and does not provide legal or insurance advice.

9. Memory Cards

Memory cards deteriorate through repeated use, and continuous recording may shorten operational life. Customers should:

  • Use only a compatible high-endurance card

  • Stay within supported capacity

  • Review footage regularly

  • Format as recommended

  • Replace on error

  • Stop using a damaged or unreliable card

An unsuitable or deteriorated card may cause missing recordings, corrupted files, interruptions or restarts.

10. ProCam AU Mobile Application and Firmware

Some functions require the ProCam AU application, a compatible device and a direct Wi-Fi connection to the camera. Performance may be affected by device compatibility, operating system updates, permissions and privacy settings, wireless interference, app-store requirements, available storage, and updates to the application or firmware.

Updates may be released to improve security, compatibility, reliability or functionality and may modify, replace or remove functions where reasonably necessary.

Customers are responsible for keeping the application, firmware and device reasonably up to date, and must not unlawfully copy, modify, reverse-engineer, decompile, interfere with or attempt to obtain the source code of ProCam software or firmware.

11. Lawful Recording and Privacy

Customers are responsible for lawful use of their dash camera. Laws may apply to:

  • Video and in-vehicle audio recording

  • Recording employees or passengers

  • Workplace surveillance

  • Recording on private property

  • Handling personal information

  • Publishing or sharing identifiable footage

Customers are responsible for determining whether consent or notification is required and whether audio recording should be enabled.

Footage must not be used, published or shared for an unlawful, misleading, defamatory, harassing or privacy-infringing purpose. ProCam does not provide legal advice regarding surveillance, privacy or admissibility.

12. Australian Consumer Law

ProCam products and related services may come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, condition, warranty, right or remedy where doing so would be unlawful. These rights are in addition to any express manufacturer’s warranty.

Depending on the circumstances, a customer may be entitled to a repair, replacement, refund or compensation where a product or service fails to comply with an applicable consumer guarantee. Customers should retain proof of purchase and contact the authorised dealer when seeking a remedy, and may also contact ProCam for support or assistance.

13. Warranty and Product Support

Any express ProCam warranty applies in addition to rights under the Australian Consumer Law, subject to the warranty documentation supplied with the product. Warranty claims may require:

  • Proof of purchase

  • Model and serial number

  • Installation information

  • Photographs, videos or diagnostic information

  • Memory-card details

  • Return of the relevant product or component for inspection

Warranty coverage may not apply to damage caused by misuse, unauthorised modification, impact, liquid ingress, incorrect installation, unsuitable power supply, incompatible accessories or normal wear and tear, except where applicable law provides otherwise. Outcomes depend on the circumstances and the rights and remedies available under the Australian Consumer Law.

14. Inspection, Testing and Repair

Customers should copy and securely store important footage before providing a camera or memory card for inspection, testing or repair. These processes may require resetting the device, changing settings, updating or reinstalling firmware, or formatting a supplied memory card, which permanently deletes all data on the card.

To the maximum extent permitted by law, ProCam is not responsible for files, footage, configurations or settings lost during an authorised inspection, diagnostic process, repair, reset, firmware update or formatting procedure. This does not exclude liability arising from a failure to comply with a legal obligation that cannot be excluded.

15. Website Use

The website is provided for general product information, support and dealer enquiries. ProCam does not guarantee the website will always be uninterrupted, error-free, current or free from harmful components, and may update, suspend or withdraw content where reasonably necessary.

Customers must not:

  • Use the website unlawfully or fraudulently

  • Attempt unauthorised access

  • Introduce malicious software

  • Interfere with operation or security

  • Scrape or reproduce content without permission

  • Falsely represent an association with ProCam

16. Intellectual Property

All ProCam branding, product names, logos, photographs, videos, graphics, manuals, website content, application software and firmware are owned by or licensed to ProCam and protected by intellectual-property laws.

Materials may be accessed for personal, lawful and non-commercial use only, and must not be reproduced, modified, distributed, sold, republished or commercially exploited without prior written permission, except where permitted by law.

17. Third-Party Platforms and Services

The website or application may link to app stores, mapping services, videos, dealer websites or other third-party platforms. Third-party services are independently operated and have their own terms and privacy policies.

ProCam does not control and is not responsible for the content, availability, security or practices of an independent third party. A link does not necessarily signify endorsement.

18. Privacy and Product Security

Personal information collected through the website, application or support process is handled in accordance with the ProCam Privacy Policy.

Information about product security, security support periods and reporting potential vulnerabilities is available through the Privacy Policy, Security, Security Support and Vulnerability Disclosure pages.

Customers are responsible for securing their mobile device, passwords, recordings and other account or device information.

19. Limitation of Liability

To the maximum extent permitted by law, ProCam is not liable for indirect, special or consequential loss arising from use of, or inability to use, the website, application or a ProCam product.

Nothing in these Terms excludes or limits:

  • Liability that cannot lawfully be excluded

  • Rights or remedies under the Australian Consumer Law

  • Liability for fraud or wilful misconduct

  • Liability to the extent caused by ProCam’s negligence or breach of an applicable legal obligation

20. Changes To These Terms

These Terms may be updated to reflect changes to products, services, the website, business practices or legal obligations.

Updated Terms are published on the ProCam website with a revised “Last updated” date. Changes apply from the date of publication and do not retrospectively remove rights that have already accrued.

21. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, it will be read down to the extent necessary to make it enforceable. If it cannot be read down, that provision will be severed without affecting the remaining Terms.

22. Governing Law

These Terms are governed by the laws of Victoria, Australia. ProCam and users of the website submit to the jurisdiction of the courts of Victoria and any courts entitled to hear appeals from those courts.

Nothing in this section prevents a consumer from exercising a right available under applicable consumer legislation.
